The Terrifying Powers of SARS: What Business Owners Need to Know

The South African Revenue Service (SARS) wields some of the broadest investigative powers of any state body—allowing officials to search business premises without a warrant, question staff, and even seize money directly from taxpayers’ bank accounts.

Legal experts at Shepstone & Wylie describe these powers as “downright scary,” noting that many business owners are shocked by the tax authority’s reach when SARS arrives unannounced.

Warrantless Entry and Search

Under Section 4(4)(a) of the Customs and Excise Act (CEA), SARS officials may enter and search any licensed or registered premises—such as importers, manufacturers, or bonded warehouses—without a warrant.

If denied entry, they are legally allowed to break open doors, windows, or walls to gain access. Once inside, officials can:

  • Question anyone on the premises,

  • Search vehicles and storerooms, and

  • Dig up floors or walls if they believe it necessary.

As long as the official acts in good faith, the business cannot claim compensation for any damage caused during the search.

Before a 2013 Constitutional Court ruling, SARS even conducted warrantless home searches—a practice now curtailed. Today, a warrant is required for private residences, and SARS must provide the court documents used to obtain it.

Direct Access to Your Money

SARS’ authority extends beyond searches. It can:

  • Freeze or attach funds in your bank account,

  • Issue garnishee orders to your employer or clients,

  • Withhold tax clearances and refunds, and

  • Obtain court judgments that damage your credit record.

These powers allow SARS to recover unpaid taxes swiftly and without prior warning.

Limits and Legal Duties

Despite its sweeping powers, SARS must act reasonably and within proper procedure. Officials must:

  • Be acting within the scope of their duties, and

  • Have a genuine belief that a contravention of the CEA has occurred.

As a state institution, SARS carries a higher duty to respect constitutional rights. Courts have held that its actions must be rationally connected to legitimate enforcement objectives.

What to Do if SARS Raids Your Business

Businesses licensed under the CEA should be prepared for possible inspections. If SARS officials arrive:

  1. Stay calm and cooperate—resisting entry can worsen the situation.

  2. Call your attorney immediately and have them present.

  3. Record everything: note the officials’ names, the purpose of the search, and any documents or equipment removed.

Shepstone & Wylie stresses that while the experience can be traumatic, maintaining composure and ensuring due process is followed is the best way to protect your rights.
