What is COIDA? - Workmen's Compensation Fund

It is a Fund that is governed by the Compensation for Occupation Injuries and Diseases Act of 1993. The COIDA Act determines how the fund should be managed and who should administer the fund. The COIDA Act also stipulates the conditions for eligibility for Compensation where employees in the course of their employment have injuries or diseases sustained.

Who needs to register for COIDA?

If you employ any part or full-time employees, you have to register with the Compensation Fund. You have to register within 7 days of Employing your first Employee.

How much does COIDA Cost?

There is a once off registration cost and then every year you pay for submission and the assessment which is calculated based on the payroll.

Is COIDA Compulsory in South Africa?

All employers, as per the Compensation for Occupational Injuries and Diseases Amendment Act No 61 of 1997, must register for worker's compensation.

Is Coida a legal requirement?

COIDA requires that work accidents and injuries and diseases sustained or contracted by employees must be reported within seven days to the Compensation Fund. Failure to do so will result in heavy penalties.

Which employees are not covered by coida?

COIDA provides extensive coverage to most employees, including casual employees, domestic workers, labour broker employees and, in the case of a deceased employee, his / her dependents. Independent contractors and self-employed workers are excluded.

Do employees pay for coida?

In terms of s22 of the Compensation for Occupational Diseases Act, No 130 of 1993 (COIDA) all employees have the right to compensation where, as a result of a workplace accident or work-related disease, they are injured, disabled or become ill. The fund then pays compensation where disablement caused by occupational activities and resulting from such injuries.

How do I get a Coida certificate?

You can either register directly with the Labour Department or use a COIDA service provider. Registering directly can take longer compared to using a service provider.

How is COIDA calculated?

Once an employer's assessment fee has been calculated according to the total of all employees' salaries divided by 100 (ration percentage) and then multiplied by the assessment tariff, this must be paid within 30 days of the assessment from the Commissioner as per Section 86.1 of COIDA.

What documents do I need to claim COIDA?

Attach a certified copy of the employees ID and a first medical report (W. Cl4) if available. The Medical Practitioner must complete a W.Cl 4 form (first medical report in respect of an accident). This must detail the seriousness of the injury and length of time the employee is likely to be off work.
